I made a terrible mistake by letting a girl that’s a heroin and crack addict move into my apartment 3 years ago when she lost her apartment. For the past 2 years, it’s been torment virtually every day. I want to walk out and lock the door and move but I can’t because I was told that she has squatters rights because she’s been living in my apartment for more than 1 month, I would get arrested and go to jail. I was told by a representative at the district attorneys office that I can move and leave her stuff in my apartment. That would be legal and I would not face any consequences. The thing is till I move in a month cause I’ll have a place then, every day is agony. I have been cut with a knife and threatened every so often with a knife spit on kicked in the shin a few months ago where I still have a mark from it cursed out terribly, and money sucked from me and my family like crazy. What can I do legally?

Call the police on her, say you think there is drug use going on in the building. Call them at night when she is at home sleeping.

Have her arrested for domestic violence, assault and battery, and verbal abuse.

In my state, nobody gets squatters rights unless they’ve been on the property 21 years. If she paid you any rent, she does not have squatters rights to your apartment – in that case she’s a tenant and you can have the owner evict her for unpaid rent and/or lease violations such as using illegal drugs. .

You can’t lock her things up inside, but you can go to the police department, swear out a complaint and have her evicted. The police can tell her and give her up to 30 days to remove her property. If she doesn’t remove it, it is abandoned and you can do what you like with it.

Sounds to me like you’re getting bad legal advice. Google squatters rights in your state.
